A Dhaka court on Thursday rejected the bail plea of former Chief Justice ABM Khairul Haque in a murder case filed over the death of Jubo Dal activist Abdul Kaiyum Ahad during last year’s July movement in the capital’s Jatrabari.
Dhaka Metropolitan Magistrate Masum Miah issued the order after a hearing on the bail petition filed by Justice Haque’s lawyer Monayem Nabi Shahin.
The lawyer argued that the case was filed with the intent to harass the former chief justice, who retired on June 17, 2011, and had remained under 24/7 police protection at his residence since August 5 of last year.
Defense counsel claimed Justice Haque was at his official workplace, the Law Commission, on the day of the incident (July 18, 2024), and later returned home under police escort. He did not visit Jatrabari, the scene of the killing, and suffers from multiple age-related health complications at the age of 81, the lawyer added.
Despite the arguments, the court denied bail.
Justice Haque was arrested from his Dhanmondi residence on July 24 and sent to jail later that day. He was subsequently shown arrested in another case filed with Narayanganj’s Fatullah Police Station, which alleges fabrication of a judicial verdict and abuse of power during his tenure.
On Wednesday, he was also placed on a seven-day remand in a separate case filed with Shahbagh Police Station on charges of delivering unlawful and politically motivated judgments.
According to the case statement, Abdul Kaiyum Ahad was shot to death on July 18, 2024, during political unrest in Jatrabari’s Kajla area. His father Alauddin filed the murder case with Jatrabari Police Station on July 6 this year, accusing 467 individuals, including Prime Minister Sheikh Hasina. Justice Khairul Haque remains in police custody.
