The High Court (HC) has issued a rule asking why the government notification cancelling recruitment of assistant teachers for music and physical education in primary schools should not be declared illegal and void.
A bench, comprising Justice Fahmida Kader and Justice Md Asif Hasan, passed the order on Monday (November 10) after a preliminary hearing on a writ petition filed in this regard.
The court alos directed the Education Secretary, the Secretary of Ministry of Primary and Mass Education, and the Chairman of Public Service Commission (PSC) to respond to the rule within two weeks.
Barrister Sarwat Siraj Shukla, the petitioner’s counsel, confirmed the information and represented the case during the hearing. Earlier, on August 28, the Ministry of Primary and Mass Education issued a notification approving the recruitment of assistant teachers for music and physical education in government primary schools.
However, the ministry later revoked that decision through a revised notification on November 2.
Challenging the legality of that revised notification, senior Supreme Court lawyer Barrister Sarwat Siraj Shukla filed the writ petition, naming the Education Secretary, the Primary and Mass Education Secretary, and the PSC Chairman as respondents.
